Birth Injuries

Birth injuries can quite frequently result in a medical malpractice case.  A healthy unborn child may be be born with severe and permanent injury if the delivering Ob-GYN failed to adhere to the appropriate standard of care.  The resulting damages can devastate a family and subject the child to a lifetime of struggle, pain, and medical expense.  Mental and physical retardation, paralysis, and other serious developmental defects can be the end result of a birth injury.  Because of the lifelong impact of these injuries, birth injury lawsuits often result in very large medical malpractice awards.

One common type of birth injury results from hypoxic-ischemic encephalopathy.  Hypoxic-ischemic encephalopathy damages cells in the central nervous system (brain and spinal cord) due to lack of oxygen.  This occurs, most commonly, when the delivering doctor or hospital fails to properly monitor the fetal monitoring strips and does not adequately respond to fetal distress.  If the unborn child is showing distress inside the womb, the delivering doctor needs to at quickly for the child’s life and safety and this often requires an emergency cesarean section.      

Another common birth injury is cerebral palsy.  Some estimates suggest that 1 in 4 cases of cerebral palsy is actually the result of medical negligence.  If your delivery was difficult and your child was born with cerebral palsy it is imperative that you speak with an experienced medical malpractice attorney.  Cerebral palsy results in serious deficits to motor and physical skills often requiring lifelong care.  There is no known cure for cerebral palsy.  Not unlike hypoxic-ischemic encephalopathy, cerebral palsy can be caused by failure to accurately read and respond to fetal monitoring strips and delaying a necessary C-section which causes a lack of oxygen to the brain.

There are countless other birth related injuries that result in serious and permanent damage to your child.  These include, but are not limited to: bradycardia, apnea, acidosis, hydrocephalus, hemiparesis, preeclampsia (toxemia), and others.
